2024 Achievements
On October 21, 2024, the Trial Court dismissed the foreclosure complaint. Our client’s goal was to gain time to cure the alleged default. Docket No. F-8118-24.
On October 18, 2024, the Supreme Court granted a Petition for Certification. A Petition for Certification is a request to the Supreme Court to review a case. The Court receives over a thousand petitions each year and only accepts about 10%. To be accepted, the petition must convince the Court that the appellate judges made a legal error in deciding the case. Our client sought to void the note of $800K. The Trial and Appellate Courts both said no. The Supreme Court will now decide the matter. Docket No. L-54-21.
On October 10, 2024, the plaintiff dismissed the foreclosure complaint. This settlement came after our client filed a contested answer in response to the plaintiff’s complaint. Docket No. F-6554-24.
On October 9, 2024, the plaintiff moved to dismiss the foreclosure complaint. Our client’s goal was to gain time to cure the alleged default. The dismissal order is pending. Docket No. F-4561-24.
On September 10, 2024, the plaintiff dismissed the foreclosure complaint. This settlement came after our client filed a contested answer in response to the plaintiff’s complaint. Docket No. F-7460-24.
On August 12, 2024, the plaintiff dismissed the foreclosure complaint. The plaintiff offered our client a modification in this case to avoid further litigation. This settlement came after our client filed a contested answer in response to the plaintiff’s complaint. Docket No. F-616-24.
On August 2, 2024, the Trial Court dismissed the foreclosure complaint. Our client’s goal was to gain time to cure the alleged default. Docket No. F-2486-24.
On July 9, 2024, the plaintiff dismissed the foreclosure complaint after our client appealed the Trial Court’s orders granting the plaintiff summary judgment and final judgment. Docket No.. F-7698-19.

On May 14, 2024, the plaintiff dismissed the foreclosure complaint. In this matter, the plaintiff offered our client a modification to avoid further litigation. This settlement came after our client appealed the Trial Court’s orders granting the plaintiff summary judgment and final judgment. Docket No. F-8040-22.
On March 27, 2024, the plaintiff dismissed the foreclosure complaint after two failed attempts to strike our client’s Answer. F-8421-23.
On March 18, 2024, the plaintiff dismissed the foreclosure complaint. In this case, the plaintiff offered our client a modification to avoid further litigation. This settlement came after our client filed a contested answer in response to the plaintiff’s complaint. Docket No.: F-12982-23.
On March 13, 2024, the plaintiff dismissed the foreclosure complaint. In this case, the plaintiff offered our client a modification to avoid further litigation. This is the 4th time the loan was modified. Docket No. F-3413-22.
On February 14, 2024, the plaintiff dismissed the foreclosure complaint. In this case, the plaintiff offered our client a modification to avoid further litigation. This settlement came after the Trial Court denied our client’s cross-motion opposing the plaintiff’s motion for final judgment, which our client intended to appeal. Docket No. F-3019-21.

On November 17, 2023, the plaintiff dismissed the foreclosure complaint. The plaintiff offered our client a modification to avoid further litigation. This settlement came after our client filed a response to plaintiff’s summary judgment motion. Docket No. F-9487-22.
On November 15, 2023, the plaintiff dismissed the foreclosure complaint after our client filed a contested answer in response to the plaintiff’s complaint. Our client’s goal was to gain time to cure the alleged default. Docket No. F-9485-23.
On November 14, 2023, the plaintiff dismissed the foreclosure complaint after our client filed a contested answer in response to the plaintiff’s complaint. Our client’s goal was to gain time to cure the alleged default. Docket No. F-8044-23.
On November 6, 2023, the plaintiff dismissed the foreclosure complaint after our client filed a contested answer in response to the plaintiff’s complaint. Our client’s goal was to gain time to cure the alleged default. Docket No. F-5338-23.
On October 26, 2023, the Trial Court dismissed this client’s second foreclosure complaint, the first is hereunder, May 26, 2023. In this case, the client came to us after the Default Judgment was entered and the Writ of Execution was filed. The documents were given to the Sheriff to sell the property. We found problems in the foreclosure proceedings that led to the judgment. A motion to vacate the judgment and dismiss the foreclosure action was filed. The Trial Court denied the motion, and our client appealed the decision with the Appellate Division. Then came the plaintiff’s offer: $2,500 and a modification to avoid further litigation. Docket No. F-2277-22.
On September 25, 2023, the Trial Court dismissed the foreclosure complaint. Our client’s goal was to gain time to cure the alleged default. Docket No. F-1981-22.
On September 19, 2023, the plaintiff dismissed the foreclosure complaint. The Supreme Court granted a Petition for Certification on a Reconsideration motion. Then, the parties settled the matter by modification. Docket No. F-22227-18.
On August 22, 2023, the Trial Court dismissed the foreclosure complaint. The plaintiff offered our client a modification to avoid further litigation. This settlement came after the Trial Court granted the plaintiff summary judgment, which our client intended to appeal. Docket No. F-4782-22.
On August 18, 2023, the Trial Court entered the order dismissing the foreclosure complaint. Our client was the tenant. His goal was to gain time to purchase the property. Docket No. F-1465-22.
On August 17, 2023, the Trial Court entered the order dismissing the foreclosure complaint. Our client’s goal was to gain time to cure the alleged default. Docket No. F-5348-23.
On August 14, 2023, the Trial Court entered the order dismissing the foreclosure complaint. Our client’s goal was to gain time to sell the property. Docket No. F-12823-22.
On August 7, 2023, the Appellate Court reversed the Trial Court’s decision and remanded the case back to the Trial Court for further proceedings. The Trial Court was ordered to vacate the Sheriff’s Sale and the Final Judgment. The Appellate Court determined that our client was denied a fair opportunity to defend the foreclosure. On June 20, 2023, the Trial Court dismissed the foreclosure complaint. On May 15, 2023, the plaintiff offered our client a modification to avoid further litigation. This settlement came after the plaintiff received our client’s discovery requests. Docket No. F-13773-22.
On May 26, 2023, the Trial Court dismissed the foreclosure complaint. In this case, the client came to us after the default judgment was entered and the writ of execution was filed. The documents were given to the Sheriff to sell the property. We found problems in the foreclosure proceedings that led to the judgment. Our client motioned to vacate the judgment and dismiss the foreclosure action. The Trial Court denied the motion, and our client appealed the decision to the Appellate Division. Then, the plaintiff offered our client a modification and canceled the Sheriff’s Sale to avoid further litigation. Docket No. F-4934-21.
On May 12, 2023, the Court dismissed the foreclosure complaint. On November 15, 2022, the plaintiff offered our client a modification to avoid further litigation. This settlement came after our client appealed the Trial Court’s orders granting the plaintiff summary judgment and final judgment. Docket No. F-9588-20.
On May 10, 2023, the Court dismissed the foreclosure complaint. On November 23, 2022, the plaintiff offered our client a modification to avoid further litigation. This settlement came after the Trial Court granted the plaintiff summary judgment, which our client intended to appeal. Docket No. F-3923-22.
On April 21, 2023, the plaintiff dismissed the foreclosure complaint after our client filed a contested answer in response to the plaintiff’s complaint. Docket No.: F-3735-23.
On April 17, 2023, the plaintiff dismissed the foreclosure complaint. On December 29, 2022, the plaintiff offered our client a modification to avoid further litigation. This settlement came after the plaintiff received our client’s discovery requests. Docket No. F-12082-22.
On March 22, 2023, the Appellate Court reversed the Trial Court’s decision and remanded the case back to the Trial Court for an order dismissing the complaint with prejudice (“with prejudice” means the mortgage was wiped out). In this case, we proved the plaintiff’s mortgage was unenforceable, meaning the property could not be foreclosed. Docket No. F-9665-20.
On March 20, 2023, the plaintiff dismissed the foreclosure complaint. On February 5, 2023, the plaintiff offered our client a modification to avoid further litigation. This settlement came after our client filed a motion to dismiss the complaint due to the plaintiff’s failure to provide discovery. Docket No. F-3243-21.
On January 6, 2023, the plaintiff dismissed the complaint. On November 16, 2022, the plaintiff deferred the default reinstating the mortgage to avoid further litigation. This settlement came after the plaintiff received Discovery. Docket No. F-4519-22.
On January 4, 2023, the Court dismissed the foreclosure complaint. After filing the Answer, the plaintiff settled the foreclosure. Docket No.: F-5866-22.
